Guest Terms and Card Payment Notice

Who you are dealing with

When you order from or pay a restaurant, bar or other venue on a page powered by VitaPay — a payment link, an online order, a code printed on your check ("scan to pay"), a gift card or membership page, or a receipt — you are buying from the venue.

  • The venue is the seller and the merchant of record. Your order, the food and service, the prices, any fees, tips and refunds are between you and the venue.
  • Your payment is processed by the venue's payment provider (for example Adyen or Payrix), under the venue's own merchant account. The payment is made to the venue.
  • VitaPay LLC provides the software the venue uses. We do not sell you anything and do not hold your money.

By paying on one of these pages you agree to these terms and acknowledge our Privacy Policy. The page records the version of these terms that was shown when you paid.

Your card details

You type your card number, expiry date and security code into fields served by the payment provider. They go only to the provider. Neither the venue's page nor VitaPay receives or stores them; we keep only the card brand and last four digits for your receipt and the venue's records. Apple Pay and Google Pay, where offered, pass the payment through your wallet and the provider.

If you choose to let the venue keep your card on file — for example to renew a membership — the payment provider keeps it, and you can ask the venue to remove it.

What you pay

  • The amount is taken from the venue's own check or order, not typed into the page. The page shows every part before you pay: the items, tax, any fee, the tip you choose and the total to be charged.
  • Card surcharges and fees. Some venues add a fee for paying by card. Where they do, the page names it ("surcharge", "card fee", "convenience fee") and shows it on its own line before you pay. A credit card surcharge is limited by card network rules — no more than 3% — and is not charged on debit or prepaid cards. Some states restrict or prohibit card surcharges; the venue is responsible for following the rules where it operates.
  • Cash discount and dual pricing. Some venues show one price for cash and another for cards. The price you pay depends on how you pay, and the venue shows both.
  • Tips. A tip you add goes to the venue for its staff and is shared under the venue's own policy and the law. Suggested tip amounts are the venue's choice; you can choose another amount or none, unless a service charge is stated as part of the price.

Scan to pay and shared checks

The code on your check opens that check, with its current amount. Anyone holding the paper can open it, so keep it with you. You can pay all of a check or your part of it. When the check is paid in full, it closes.

If a payment does not go through

If a page says a payment is still being confirmed, do not pay again. Wait, or ask the venue — the page will show the outcome once the provider confirms it. If you are charged twice, contact the venue.

Refunds, cancellations and disputes

  • Refunds and cancellations are decided by the venue under its own policy. A refund goes back to the card you paid with; how long it takes to appear depends on your card issuer.
  • Gift cards and memberships are issued by the venue, under the terms shown on their pages.
  • If there is a problem with an order or a charge, contact the venue first. Your rights with your card issuer, including to dispute a charge, are not affected.

Online orders

Orders you place go to the venue, which is responsible for preparing them, for allergen and ingredient information, and for delivery or pickup times. Tell the venue about allergies directly.

Receipts

You can have a receipt sent by email or text message. A receipt link works for 90 days.

Messages and your information

The venue receives your order and the contact details you give it. It may send you marketing only if you agree, and you can stop text messages at any time by replying STOP. How your information is handled is described in our Privacy Policy — the venue's own privacy notice may also apply.

Our part

VitaPay is responsible for running the software reliably and securely. To the extent the law allows, we are not responsible for the venue's goods or services, prices, fees or refund decisions, or for the payment provider's processing.
